Motion instituting proceedings

If you have access to a computer or a mobile device, you can file an online proceeding. To do so, you must follow the steps and provide the required documents.

Electronic

You can also use the form Motion Instituting Proceedings form and the instructions. The form can be completed on your screen, printed and then sent to the Secretariat of the Tribunal  by regular mail or by fax. You can also file it at the Secretariat of our offices in Québec et Montréal.

Paper

If you are unable to download or print the form, you can obtain it at the offices of the Secretariat of the Tribunal or at one of the clerk’s offices of the Small Claims Division of the Court of Québec, generally located at the courthouse.

Subpoena Form

f you think that a witness will not attend the hearing, you may ask the Court to order the witness to be present. To do this, you have to complete a document called "Subpoena" and have it signed by an administrative judge. To obtain this signature, contact the Secretariat of the Tribunal. Your lawyer, if you have one, may complete and sign this document.
