The mental health division of the Tribunal administratif du Québec has jurisdiction in two types of cases in the field of mental health:
Cases concerning the release or detention of persons suffering from a mental disorder, who have been accused of having committed a criminal offense, and who have received from a criminal court a verdict of unfit to stand trial or a verdict of not criminally responsible on account of mental disorder. When the Tribunal assumes this type of jurisdiction, it is designated as a Review Board for mental disorder ("Review Board"). The rules governing the jurisdiction of this Review Board are found in Part XX. I of the Criminal Code.

Some cases under the Act respecting the protection of persons whose mental state presents a danger for themselves or others.
The Act deals with persons confined in a hospital because they are deemed dangerous to themselves or to the public.
